Article 2 – Scope of Application

  1. These General Terms and Conditions apply to every offer made between SIGNORE and the buyer (any individual or legal entity acquiring or using products or services marketed and entering into a contract, whether remotely or not, with SIGNORE).
  2. The delivery address provided by the Buyer must be in Belgium. For other countries, a specific offer regarding the transport modalities must be validated by both parties.
  3. In order to place an order, you must be at least 18 years old.
  4. By using the SIGNORE website and/or placing an order, you accept these General Terms and Conditions as well as all rights and obligations as mentioned on our website (http://www.signore-distillery.com/).
  5. In the event that, in addition to these General Terms and Conditions, specific conditions apply, the above also applies to these special conditions. In the event of conflicting General Terms, the consumer may always rely on the provision that is most favorable to them.

Article 3 – Offers & Contract Formation

  1. If an offer is valid for a limited period or is subject to certain conditions, this will always be explicitly mentioned in the offer.
  2. Our offer includes a complete and precise description of the products offered and the ordering method. The description is detailed enough to allow you to properly assess the offer. If we use illustrations, they are a faithful representation of the products offered for sale.
  3. Your order will be complete, and the contract will be formed as soon as we have confirmed your order by email for direct sales (to both professionals and individuals) or, if you order through our website, as soon as we have received approval of your transaction from your credit card issuer. We accept the following payment methods: Visa/Mastercard/American Express/ bancontact. We are not responsible for delivery delays and/or non-delivery of your order if these delays are due to the refusal of your payment by your card issuer. No order is accepted or processed without valid payment in the name of the (registered) cardholder.
  4. To purchase a product on our website, you add it to your cart. Then, you complete the form with your personal details and billing information, and select your delivery method. When placing the order, you will also be asked to accept our General Terms and Conditions (which are visible on our website).

Article 4 – Right of Withdrawal

  1. For any order of SIGNORE products, you have 14 calendar days from the delivery or conclusion of the contract to withdraw from the contract. During this time, you can return your order without penalty and without giving a reason (return shipping costs are at your expense). Within 14 days of receiving your return or the termination of the contract, we will refund the full purchase price to the account linked to the payment method used by the consumer for the original transaction.
  2. The return shipping costs are therefore at your expense. We will indicate the exact cost for this return or provide an estimate if it is impossible to predict the exact cost.
  3. During the withdrawal period, we recommend handling SIGNORE products and packaging with care, and not unpacking or using them unless necessary to assess whether you wish to keep them. If you exercise your right of withdrawal, we ask you to return the order in its original condition and packaging.
  4. You can return your package by post to the following address: SIGNORE SRL, Avenue des Sansonnets 46, 1410 Waterloo – Belgium.

Article 5 – Prices

  1. During the validity period mentioned in the offer, the prices of the SIGNORE products offered will not be increased, except for price changes due to changes in VAT or excise duties.
  2. For orders placed on our website, the prices include all taxes, fees, and delivery costs, which may vary depending on the order.
  3. For direct orders (not placed through our website), the prices for both our products and deliveries will be those listed in the offer validated by both parties.
  4. All our prices are quoted in euros.

Article 6 – Payment

  1. Payment for orders placed online is limited to the payment methods offered on our website.
  2. To ensure secure online payments and safeguard your personal data, transaction data is encrypted with SSL technology and transmitted over the internet. To pay with SSL, no special software is required. You can recognize a secure SSL connection by the “lock” in your browser’s status bar.
  3. Invoices must be paid within 15 days of their dispatch (invoice date) to account number BE91 3631 8286 8076 (BIC: BBRUBEBB) opened in the name of SIGNORE SRL. In the event of late payment, interest at the applicable legal rate will be charged to the customer. If the customer is a commercial enterprise, the applicable interest rate will be the one determined each semester by Royal Decree under the law of August 2, 2002, concerning the fight against late payments in commercial transactions. In addition, the customer will owe an irreducible flat-rate compensation of 15% of the unpaid amount, with a minimum of €175.

Article 7 – Conformity & Warranty
We guarantee that our products comply with your order and meet the normal expectations you may have, taking into account the product specifications. We also guarantee that our products comply with all existing laws at the time of your order.

Article 8 – Delivery & Execution

  1. Deliveries are made to the delivery point located:
  • either at the nearest collection point to the address provided at the time of your order;
  • or at the address provided during your order.
  1. If the ordered product is in stock, we will ensure delivery within 15 business days. For items that are not in stock, we will inform you of our best estimate of the expected delivery date in your order confirmation.
  2. If we are unable to deliver on time, we will always inform you before the scheduled delivery date. If we do not inform you in time, you have the right to cancel your order without charge. In this case, we will refund you within 30 days of cancellation.
  3. The shipment of your order always takes place at the risk of the carrier. The return of goods you send back to us within 14 days of purchase because you do not wish to keep them is always at your own risk.
  4. If the goods delivered by us have been damaged during transport, do not correspond to the items on the delivery note, or do not match the items you ordered, you must inform us as soon as possible, and at the latest within 3 days of receipt. You must then return the relevant items to us within 14 days of receipt.

Article 9 – Force Majeure

  1. In case of force majeure, we are not obliged to fulfill our obligations towards the other party. In this case, we have the right to suspend our obligations for the duration of the force majeure or to definitively cancel your order.
  2. Force majeure is understood as any circumstance beyond our control that makes it wholly or partially impossible to fulfill our obligations towards you. These circumstances include, but are not limited to: strikes, lockouts, labor disputes, fire, technical incidents, power failures, disruptions in networks, lines (telecommunications), or communication systems used and/or the unavailability of our website, non-delivery or delayed delivery by suppliers or other third parties, and the absence of authorization to receive through authorities.

Article 10 – Ownership of Files
All data on this site (images, texts, graphic elements, logos) are protected by copyright.

Article 11 – Retention of Title
We retain ownership of the goods sold until full payment of the principal and accessories, including any penalties and interest owed to us. Failure to pay any of the installments may result in the repossession of the goods.
As long as the price has not been paid in full, as specified above, the customer is prohibited from pledging the goods in any way, offering them, or using them as collateral. The customer is expressly forbidden from selling or disposing of the goods in any way.
These provisions do not prevent the transfer to the customer, upon delivery, of the risks of loss and deterioration of the sold goods, as well as any damage they may cause.

Article 12 – Means of Communication and Proof
As part of the execution of the mission entrusted to us and subject to applicable legal provisions, the parties agree that online communications and email will be considered proof of their content and may serve as evidence of the commitments they contain.

Article 13 – Complaint Procedure

  1. We always hope that all our customers are 100% satisfied. If, however, you have any complaints, we commit to processing them within 3 business days following the receipt of your complaint. Do not hesitate to contact us:
    • by email: info@signore-distillery.com
    • by mail: SIGNORE SRL, Avenue des Sansonnets 46, 1410 Waterloo – Belgium
  2. Belgian law exclusively applies to all contracts with our customers, regardless of their place of residence. All disputes related to or arising from SIGNORE’s offers are subject to the exclusive jurisdiction of Belgian courts and tribunals. If, for reasons of international law, another law should nevertheless apply, it will first be interpreted in accordance with the Belgian Law on Market Practices and Consumer Protection.
  3. The Mediation Service of the Federal Public Service (FPS) Economy is competent to receive any request for out-of-court resolution of consumer disputes. Either the Consumer Mediation Service handles the request itself, or it forwards the request to a qualified entity for further processing.
